Point based system!!!! Is this is joke???? Tell me this is not true and this is just a bad dream, please!!!!
Let�s see what a point based system has done to people..... Whom do we have here, a doctor, an engineer and one MBA. OK!!! Lets see what Point based system did to these guys -

No offense to anybody from Canada. I am simply trying to illustrate the rationale about the GREATEST IDEA OF THE CENTURY, THE SILVER BULLET, THE FINAL FRONTIER TO ALL IMMIGRATION PROBLEMS - "point based system"!!!!! Oh really???
As such, Canada does not really have as many jobs as in US. Offcourse it is a fact that PhD and Doctors drive cabs in Canada because they can't find jobs, but someone who is not a US citizen finds a good job in USA because it is simply the land of opportunities.
I am not saying points system is the best, but opportunities play an important role and thats why US has so many jobs compared to other countries, though so many jobs are outsourced. There is always growing demand and the economy is huge and accomodative.
Canada on the other hand is still slow to add jobs it the pace America does because of the lack of infrastructure (As I have not been in Canada, I don't have much information on how things work, but I know for sure that getting jobs is very difficult)
We must have a seperate thread on merits and demerits of points based system over the existing system and the issues being faced in countries like Canada etc..

I agree with you totally. Being patient is a good way to take this. I have seen this happening at my work place too. But until we get GC we have to learn to handle this. We are 16 desi's in my company and my managers says that many "co-workers" are jealous as it seems that we are taking their jobs
etc.
I hope this CIR passes and I get EAD and I shall try to leave as soon as possible.

We can also look at the possibility of mass drive towards bone marrow doner registration, Blood donation drive, Eye donation, etc.
Also possible is continue with Youtube videos. I think the reason for low response a) laziness b) doing alone may not be exciting and motivating enough.
Suggestion. We do the youtube videos in groups of three/four. It would be fun activity and will help to build bond amongst IV members.

As per the state dept folks, pretty much all categories are using all their allocated numbers. So where is the spill over going to come from?
country quota will not impact I and C once the dates are current for ROW due to the spillover. If the number of applications pending is, say 100K and 95 K out of that are I and C. And assume 10K applications from ROW are add to the queue, what I am saying is all 110K will be cleared by end of the fiscal year.

Apparently someone flagged me.. thats fine.. if people here cannot have a proper discussion without having to flag each other I dont see any point in calling ourselves "smart" "highly skilled".. looks like we need to grow up first. Thats what my Question is......how i am gonna prove it i paid 3k for my H1. They are deducting 500 (for my H1) everymonth from my paycheck in the name of CASH ADVANCE DEDUCTION.
I really want to teach them a lesson....so that they stop messing many vulenerable people like me who go to them every year. Could somebody tell me how i am gonna complain DOL in new jersey about this company and does DOL really takes any action.
Greencard is not i am much looking for......i am planning to go back to india after 2-3 years.

it depends on who is in which category ..I feel the above (1 -2 -3) is unjust ..not that I/we can influence how it flows. my view is that the category which is at the end should get more visas ...and I would support this even if things change tomorrow (EB3 current and EB2 severly retrogressed or EB-wwide - retrogressed ..not that it will ever happen !!)

About half-a-million highly qualified professionals and their families have put their faith in the legal immigration system and due process of the United States, while working to enhance the US economy. These people have pending petitions either with the Department of Labor, or with the CIS, the final adjudication of which will enable them to work with a US employer, with consequent ripple effect on the US economy.
In the old system, employment-based petitions were limited to 140,000 per year, but the proposed system, �in order to reduce backlog�, reduces them to 90,000 per year only! On the contrary, Family-based cases used to be limited to similar numbers, but now have been increased to 567,000 per year! In addition, close to100,000 of these applicants with pending petitions are being asked to start from scratch in the new system. In effect, it is similar to changing the �rules� or rather, the �Laws� after the fact! Innocent high-skilled prospective immigrants are being penalized due to bureaucratic delay in the DOL.
Highly skilled doctors, scientists, engineers, and computer professionals have been stuck in backlogs since the last 3-4 years. These ppl are talking about giving amnesty to ILLEGALS...let me repeat it.. amnesty=award for being ILLEGAL. They have done that before and all of a sudden we F'KIN LEGAL TEMP WORKERS from India/China have to worry about the LEGAL aspect of filing a law-suit.

The poll shows that there are substantial number of cases from Yr 2004 or earlier. This shows that the Dates will be going back in October Visa bulletin. If the number of applications are 50 times of the polled numbers, then also it will take 2-3 years to clear the Yr 2004 and earlier applications.

For someone from India EB3, this warning is useless. Dates have not progressed for 6 months...
April 2001 to October 2006.....lets see... the wait is 4.5 years. Even Mexico which send several magnnitudes more immigrants to the US has now moved to May 2001.

makes sense...they are expecting alot of 140/485 combine filings in July and by issuing this bulletin they have stopped people from filing 140 in PP
When I saw the huge movement in June followed by the July bulletin, I'd thought to myself - it's a question of time before they suspend/terminate the 140 PP. The PP demand would come not from people who are filing 140/485 together (because that would be only people who just got the LCs) but rather people who had already applied 140 but not 485, or those who 140 is pending but 485 got current.
This change could at least benefit those who have a "normal" 140 in the pipeline, but that's doubtful because I'm sure these resources would get sucked into the tsunami of 485s in July.
The fact that it says they'll reconsider this after Aug 1 suggests that they do not anticipate too may 485 filings in Aug => chances of retrogression in Aug bulletin is now higher, if it does not retrogress mid-month!

Let us say USCIS has unused visas, which they want to allocate and they have moved cutoff dates to Jun, 2006 for EB2, similarly Sep 03 for EB3.
My question is, will the visa issuance would be in the order of Priority Dates? or Notification Dates? Recently there has been lot of pressure on USCIS to issue processing results based on Priority Dates, will this force USCIS to correct its ways and issue visas based on Priority Dates.
I might have digressed a little bit on the topic of predicting cutoff dates but this question is lingering among all the IV folks who would be current or already current.
