LUD for my wife before RFE. RFE on just mine. got 1HLUD and 3 SLUDs on just mine after RFE received, no transfer on both cases

I am just confused that how they assigned 70K EB2 visas in 2008. Because EB2 share is
40k + 4k(EB1 left over)+? how many FB = 70k . So from above it looks like all FB leftover went to EB2.
Please clearify.

The one consolation is that once you get to file your 485, you should not spend too much time in that pending 485 situation.
So if you ask me today, would I rather have filed 485 with a PD of 2006/7 or be in your situation, as bleak as your situation looks today, the better choice might be your situation.

Well that depends on lots of things. If your assumption is that the PD is gonna move slowly and gradually forward, then what you are saying is true. Again, once he/she files 485, his 485 is not going to be processed immediately. AP, EAD may be issued but it may take 6-9 months for 485 to get processed.
However, if PD moves so much ahead that your PD is also current, then you will get your GC (if other processes are complete) whereas he/she would have just filed 485.

The Telugu news channels certainly dramatize the issue and blow up the story. I sympathize with the students and their parents for the difficult time that they are facing. But, these students are not being tortured like criminals and terrorists.
I believe these students were questioned by the USCIS and released on bail. Because these students are required to give evidence against Tri-Valley, they are released on bail after questioning. They pose a risk of flight and hence they are radio tagged.
If these students were attending classes like thousands of F1 students across the country when the university was shut down, they do not have anything to worry about. They can leave the country or transfer to a different university. If they were legally working as interns in positions that are allowed by the CPT, they still have nothing to worry about.
If these students were working at gas stations and convenience stores across the country instead of attending classes, they have broken the law. They are liable for prosecution. CPT is intended to complement your education with practical training. Working at gas stations and convenience stores does not qualify for CPT. For almost all disciplines except IT & software engineering, working for software consultants on CPT is illegal.
These students bring F1 program and Indians into disrepute. Incidents like this also give ammunition to anti-immigration lobby in this country.

FBI background check delay is the only reason why visa numbers are wasted every year. Pending I485 cannot be adjudicated and allocated visa numbers due to pending security checks. At the same time these pending I485s also don't let the visa bulletin dates move forward fast enough. Just wait and see how this problem is going to get worse in the coming years.
Retrogression is a serious problem right now due to quotas and country quotas. But backlogged FBI checks will make it worse for thousands of people.
I agree with everybody on this thread. I agree this solution ( if any) will be a band aid. I also agree the band-aid is needed to prevent the wound from becoming fetid. I agree this may exacerbate problems.
For all these reasons, it is imperative we do not stop after this anouncement. Our long term goal has to be retrogression relief in one form or the other, including all or some of recapture of unused visas, increase in annual quota, resolution of the FBI name chack black hole, and more that able persons in IV can doubtless think of better than yours truly.
I, for one, am going to be a member of IV long after this anouncement.

Folks,
I cannot seem to find the section of the bill re: invalidation of pending applications, that is causing everyone so much heartburn. Someone referenced section 502(d)(2), however if I look on thomas.gov, that section of the bill is about per country limits. Can someone supply either a) latest version of bill text or b) correct section reference regarding current and pending applications?

A PhD does not automatically qualify you for EB1. There are a lot of other requirements. Unless you are in a research or teaching job, it's hard for PhD's to qualify for EB1. Besides, there's the small matter of getting an H-1B or O-1.
If she has a PHD in CSE she should look for a job get H1 and file Green Card in EB1 all off this can be done in 6 months! What's holding you back???? :)

When I used term misguide, I was reffering to "I-140 Approval". Here is another attempt to clarify:
If you concurrently filed your application and if it is more than 180 since you filed and your I-140 is not approved yet, then can you use AC21? The answer is yes as per Yates memo. Even though your I-140 is not approved at the time you invoked AC21, USCIS while adjudicating the petition should determine whether the I-140 was approvable at the time of filling? Please read the memo, if you have not done so.
In nutshell, I-140 approval is not required for invoking AC21, if application was filed concurrently and has been pending for 180 days or more. Attorneys ask you to remain in your job, so as to minimize the risk.
Kindly see the context of the post and please read the post completely before going ballistic �
