I am filling the I765 Form.
I have couple of questions.
1) in 11th column. Which USCIS Office( Am I write Nebraska or Nebraska Service Center) and What about Date? which date .... EAD Applied Date or EAD Approved Date?
2)I Enetred in to US Using AP but I am on H1B only so what is my Current immigration Status and Manner of Last Entry

Per my attorney and several forums i researched a second FP Is generally sent when your case is about ready to be approved and normally a good sign as they can approve GC and ask for FP after that before sending you cards. However in one forum i found someone posted a DHS release from 2007 describing the FP data is switched to digital storage in a system called BSS and will remain valid for 75 years, thus one theory says that if your first FP was done digitally you may not need second FO and IO can access the results of first FP and approve. But who knows what is true, all of these are speculations.
I have not got second FP notice either and my first and only FP happened in Nov 2007.
I got a 2nd FP notice for 485. I will be current next month. I also applied for AP last month, which got approved yesterday. Not sure if AP application triggerred the FP notice or if there is a chance I can get approved next month??

I found this interesting comment from a blog. It has been posted by an H.R. representative who has access to H1B and GC users' records. The points raised are indeed valid and they seem to have a 'case' against us. I do not by any means want to undermine our efforts but it does provide a perspective from the 'citizens' perspective.
The bill would also drastically increase the number of H-1B visas issued to foreign professional workers. As a Human Resources representative, I see first hand how the H-1B visa and employment based green card programs actually work together to drive U.S. white collar workers from their jobs and even from their careers. To begin with, there is virtually nothing in the law that prevents employers from hiring H-1Bers for open positions even if qualified Americans are available and willing to do the work. Americans are routinely laid off and replaced with lower paid H-1Bers also. In these cases, Americans have practically no legal recourse available under current law. H-1B is also a dual intent visa, so an employer may sponsor an H-1Ber for an EB green card for legal permanent resident status. When a company seeks to sponsor a foreign worker for an EB green card, they are required by law to demonstrate a good faith effort to recruit Americans first. This process is called labor certification. But employers routinely game the labor certification process for green card sponsorship to defraud even well qualified citizen job applicants in favor of low wage foreigners. They use fake job ads and/or bad faith interviews of American citizens to convince the federal government that they tried to find American workers first. These practices are common in high tech and even in some non-tech industries, but HR people are told to keep quiet about it or lose their jobs.
I would be in favor of a program that issues a small number of self-sponsoring green cards for truly innovative foreign nationals on a competitive basis. But very few of the H-1Bers or green card applicants that I have seen in 10+ years even come close to being truly innovative. Most are just practitioners with skills that are actually quite common among the domestic workforce. The only thing special about these foreigners is that they will work for substantially less than Americans in order to have a chance to become legal permanent residents. Thus they are used by management to sweeten corporate balance sheets.
The prevailing wage regulations are supposed to insure that foreign nationals are paid the same as their American counterparts in the same job functions, but these regulations are so riddled with loopholes that they are a bad joke.
Since my work allows me to have access to salary records, I can tell you that the labor cost savings for H-1Bers and green card applicants is substantially greater than the costs of filing the applications with the government.
Citizens should demand that both the H-1B and employment based green card programs be abolished in their current form.
My point is if we check our credentials, how many of us are 'true' innovators? I know I am not, I am an expert in what I do and am an asset to my company but I haven't filed any patents or publications which would be the true requirement for this country. My skills are indeed readily available in domestic workers as well. Could that be the reason for the backlog in EB-3 and none in EB-1? So do we need to do a reality check here? Just wondering if this could be the reason why we're getting a raw deal. Could it be that 'highly skilled' is not enough but 'genius' and 'highly skilled' is what's required here? Just a thought.

Dude I think you are thinking too much of it. USCIS is an organization that goes by a process. If they have a pending application, they have to process it. they decided in the summer of 2007 that they will hire additional contractors and process all the pending applications so that they reach their goal of 4 months processing times of 485.
Why will they waste their resources on your $325 dollars again dude? Is the amount that high that they will reopen the case at the time of finally alloting a visa number, and spend the money/resources on reviewing the case again?
Whatever be the PD, USCIS is all set for a month processing time of 485 by Sept 2009. All cases filed before Jun of this year should have been either pre-adjudicated or denied by that date.
I don't want to drastically oppose anybody's view or perceptions... But still I don't think that USCIS is an organization which goes with all the so called process models and they will stick with processing of the cases with priority basis - Yes, including all their country, category, etc quota fandas...
Otherwise we would not have seen people who are all with 2006 PD getting approvals where those who have better priority dates (with out tied up with any name check or other hassles) in the same cateogory and country are still waiting... Who knows whether they have some other agenda by getting 1000's of $325 from each applicant upfront, even they very well know that they would not able to do anything for those people in the near future? So why do they worry to take a few contractors for the time being and say bye bye after some time to them. By those uneducated contractors we have suffered a lot of back and forth mailing of the applications during 2007 July, there by making good business for Fedex and USPS. Anyways by that most of us got EAD... Thanks to such an act by the so called organization run by process model :D
Needless to say the small efforts as preadjudication or so will hopefully shed some light for our endless wait. I appreciate it... Better late than never. Atleast if they stop kicking the processing dates back and forth, just what we have seen in the last couple of months and offcourse in the past also, I would say "God Bless USCIS" for not making us fools again and agian.

Are you saying IV can't find anyone IV trust to do this, or nobody in IV core thinks it is woth it to do some extra leg work? I don't think IV has the luxury of not doing the leg work. Every peny counts.

there are good reasons for the temporary stops to the checks. everything need not be publicly anounced. please leave it at that.
and while we are at it...we need help with the leg work...please complete your profile so we can get you involved with some of it...it would be great to have you as a volunteer!

Hi,
My EAD renewal was filed in TSC in the middle of June. Now it is more than 2 months I haven't heard anything from them. I wonder do they request for FP during EAD renewal ? When I applied for EAD first time in 2007 there was no request for FP and the EAD was approved without FP. But I have seen several posts where folks mentioned that they have got FP notification after they filed their EAD renewal. I have done one FP beginning of 2008 as part of my AOS filed on July 2, 2007. So, I wonder do I receive another FP notification as part of my EAD renewal or USCIS can use my existing FP (they may have in their system) ?

I'm glued to C-SPAN whenever anything related to immigration is going on in the senate. This time I wasn't aware of it.
We need to be more alert this time. Maybe a phone campaign or web-fax campaign would have turned the scale! We gotta be more alert.
Don't worry. This is not the complete defeat yet, since this ammendment ties into the troops withdrawl bill. The president would have definately vetoed the bill.
The bigger thing is the SKILL ACT, which has yet to be at the floor. If we really want any success, we have to ensure that the immigration act is passed a a standalone act and not an ammendment to any other bill regarding defense.

I recently applied (08/30) for advance parole as a new application (not renewal) at TSC, will I get a finger printing appointment from USCIS. Adjustment in Dollar exchange is good for both US and Indian economy, if $ hits Rs 38, this will certainly makes outsourcing even more expensive, Indian companies which are currently overrated will have much needed adjustment and the ripple effect of which can be seen in local Indian market such as realestate etc. In a long run this is good,

yes, retrogression will remain the same for indians and chinese.....its already pretty bad for the indians. retrogression will hit ROW harder as they are current right now....atleast for EB2. let feb or march 2008 roll around then its going to get worse.
