Nathan, it is not about MMS, it is about congress. MMS is just a puppet as he was during Narasimha Rao's govt.
Can you tell us with 100% surety that MMS will not get replaced by Rahul Gandhi after 2 years?
Yes...only that puupet brought those changes and reforms. I dont have any issues for Mr. Advani, but please show me some track record as he was part of the ruling party for five years.

the cycle for visa exhaustion has to happen before USCIS triggers action....its just not how many applications showed up on their door...and one(including me) should not feel toooo bad if we are not able to submit application becasue the visa numbers were exhausted. More painful will be if it is only based on applications received and mine went in a little later than others. lot of hard works has gone into prepraing this application. I would hire my attorney to put a suit against himself...
As i understand it...number of applications received by USCIS on july 2nd does not in any way affect the acceptance of application on july 22nd......do you see it as i see it
Does someone know what date in June they started turning back EB3-Other WOrkers?

vdlrao, Thanks for the great analysis.
I am using DOS visa statistics and I arrived at EB quota numbers for 2008 as 162,707. There were 22,707 unused FB visa's in 2007 based on the DOS visa statistics @ http://travel.state.gov/visa/frvi/statistics/statistics_1476.html
Typically the actual EB quota for the FY is revised in the September bulletin. I am not sure if DOS has already taken into account the new EB quota number for the Aug bulletin. If they hadn't taken into account the new quota number then we should see some forward movement in the Sep bulletin.
However the 28,795 AC-21 recaptured visa's U are talking about has already been used in 2002, please take a look at the below mentioned link for details regarding the usage of those visa's.
http://travel.state.gov/pdf/FY2003%20AppD.pdf
All the AC-21 recaptured visa's has been used by now.
mpadapa, I am getting 31,100 unused Family Based Visas for 2007 fiscal year from
http://www.dhs.gov/xlibrary/assets/statistics/publications/LPR_FR_2007.pdf
.
DHS bulletin is not updated correctly like Employment Based AC21 VISAS? Please let me know.

Did you get a job in US before you came to US. Most probably not.
There are a lot of people who come to US blindly like students or consultants. They also landed up jobs (doing what they were meant for and not as cabbies or as janitors) and built careers.
There are no or few body shoppers in canada because there are only a few shops :-D
For the majority this is true in US. This is what land of opportunity means.
It might be true for a few cases in Canada but for the majority it is false advertisement. Canada is not a land of opportunity. This is not a few of those who have been burnt talking. Try getting a job in Canada. Look at the salaries for yourselves.
Folks am again telling this for your own benefit only. I have nothing to gain. I was not wise to do that. So thought I would guide the poor wandering souls here. Dont waste your dollars in Canada PR when you have US GC pending. It will do you no good.
I wont post on this thread again :)

If you see the numbers for EB2 ROW there are still 7000 visas pending.
Offcourse many are from 2007 and 2008
How is it possible? Is it not EB2 ROW and EB1 was always current?
1997 1
1998 3
1999 1
2000 11
2001 47
2002 67
2003 69
2004 219
2005 493
2006 973
2007 1,531
2008 3,473
2009 262
Grand Total 7,150
Also EB1 has the following data
1997 4
1998 1
1999 0
2000 1
2001 32
2002 57
2003 32
2004 29
2005 41
2006 135
2007 537
2008 898
2009 710
Grand Total 2,477
Does this mean this data is not accurate as of date. So if it means that all of those applications are approved as of today there are no more EB2 ROW 485 applications pending for FY 2010 apart from the recently filed in PERM stage?

I wish your hopes comes true. However, one thing you should remember. There are many guys with PD before 2005 got stuck due to name check, particularly in ROW catagory. This big jump in PD for ROW and new name check clearance rule, will makes tons of 485s become eligible for approval in March.
As they mentioned in their comment, they may freeze the PD for ROW in APril or move back to 2004, depending on how many EB3-ROW gets GC in March.
Ramba,
I see the comment where USCIS said date movement can slow down or stop, but didn't say anything about going back to an earlier cutoff date. Of course, I am pretty sure that State dept didn't take into consideration the new Name Check rule. So as we have seen before, anything is possible :)

Also out of the 65K H1 visas that were available since 2003, most of the Visas were consumed by the Big Indian companies.
Remember when Congress sent letters to the Big Indian companies, there was data related to how many companies applied for how many Visas.
AFAIK it was in the range of 25k-35k per year combined by all these companies that filed H1s .
One thing to note is, they do not sponsor GCs for all the applicants. They do them very rarely for the people who are in their 5th to 6th year of H1.Could be in the range of Hundereds and not thousands comapred to the people count they have in US.
Yes, you bring up a valid point however consider these two points also:
1) They also bring a lot of people on L1 visas.
2) A lot of people come to the USA on a H1 with these Indian companies but then find employment with another US employer willing to sponsor their H1b visa and then move jobs, and transfer their H1b visa with them.

Some moron gave me a Red for my post below with the comment ".."
Seriously dude, if you are so naive as to think that ROW folks are just going sit around and watch EB2 India consume the spillover numbers, then get your head examined or stop smoking that pipe. Have you ever wondered how low the participation is from ROW applicants on these forums? This is simply because for the most part its become a desi forum mostly dominated by EB2 folks.
Or you can give me another red and stick your head back in the sand (...or in those clouds, whatever the case may be)
A lot of EB2 folks are getting excited about getting the spillover from EB1 and EB2 ROW but has anyone contemplated that lots of EB3 ROWs will now start at looking at porting their dates to EB2 just as most people from EB3 India are?
Boy, I sure wish I was a lawyer! If this system remains as screwed up for another 20 years, I am surely sending my kid to law school :D

Did you ask you lawyer? It's so much easier to criticize.
My immigration lawyer laughed when I asked about a possibility of filing WOM to force action on my stalled I-485. So I proceeded myself. Yes, I did many mistakes but I ultimately prevailed. AILF lawyer and Assistant US Attorney could not believe that an ordinary programmer can write quality legal briefs and challenge the government. Some of my friends did not bother with WOM and are still waiting while others followed and received green cards. If you think outside of the box, you can achieve something others could not.
Not sure if this was answered earlier... however, since this is employment based immigration and every step of the way we've needed to have our employer's approval/sponsorship to do anything; can 485 beneficiary be a plaintiff in such case without their employer's consent? especially if employer is one the the major corps.? how realistic it is to assume that a major corporation. would like one of their H1-B lead class action against USCIS?

Lessons YSR taught Sonia (http://blogs.timesofindia.indiatimes.com/masala-noodles/entry/lessons-ysr-taught-sonia)
Snippets.. go through all the user comments on the post in TOI.
YSR moulded democracy in AP in his own feudal mode. Hailing from the drylands of Rayalseema, where barren agriculture and lack of industry made an industry out of violence and extortion
YSR devised his own framework of governance that he started implementinng the moment he came to office in 2004. Simplistically stated this framework was an adaptation of the old zamindari system: under this YSR parcelled demarcated areas of the state to his loyal followers (who were elected as MLAs and MPs from these areas). Within the jurisidisction of these areas, these loyal followers were the kings - they were free to do anything (within limits) using the state's administrative machinery. In return, YSR wanted their loyalty and resources for the party kitty
Well, YSR delivered the state to her not once but twice and also financed a large part of the Congress campaign costs. In this comfort, Sonia forgot that the loyal Congressman had converted the party into his own personal satrapy

Wake up, buddy. This is IV. Not !
Removal of Country caps was, is and will be one of the top agendas of IV , whether beneficiaries of a discriminatory system like you support it or not. It's morally and ethically repugnant to see discrimination based on country of birth in the 21st century. Just because it benefits some like you, it doesn't become right.
Employability has nothing to do with Country of Birth. When we are selected based on merit, skill and education by our employer, why should we suffer just because we are born in the wrong country?
It's time to throw away this last vestige of discrimination inherited from the previous centuries and move to a future where every individual is valued for what he/she is individually and not based on whether he was born in India or Sri Lanka.
Only India and China & one or two more countries will support the removal of country limit. The rest of the world will actually oppopse this move as it will have a negative impact on their processing times greatly.
There was a discussion on this on sometime ago.

The BECs would chew on the TR cases and throw out 100 K approvals in the next few months....That it .... Sayonara for the EB3 world current dates too.....
