The case is not in his wife's hand anymore. As soon as the police came on site the case is People Vs Terriblething. Only thing is that the DA may be a little weary of pushing too much if his only eye witness (the Wife) does not want to push the matter.

The way i see it, they've asked for past emp letter with tax forms and some w2s.
None of those would indicate that you were on the bench.
The emp letter should basically just indicate your dates for employment - start/end date, designation, duties and perhaps salary. that's all.

We all are working and in this economy everyone is worried about losing job if they don't go to work. I have two little kids and I work full time. I already used the vacation that I got for this year, it because of kids being sick one after the other and need to be off again next month for loss of pay for a kid's surgery. I know its just two more days and might result in something positive but I can't take a chance of losing my job and then don't have a job when it�s time for my 485 to be approved resulting in denial.
I will donate money but unfortunately, I can't come for the advocacy day. It is a sticky situation for many.

After incorporating the company in one of the states. What are the next important things one as a owner of the company needs to take care of especially if it is in IT product development area ( ofcourse including consulting but not purely comparable to predominent desi consultancy services)
Specifically in the following category:
1. If you are selling IT software products and services, what are the legal necessary formalities one needs to take care of?

My wife's EAD was also pending for about 4 months. At infopass, officer said we have to wait. He asked to check back in 10 days.
Within 2 days, status changed to "card production ordered". Before, we had sent expedite request also.

Your employer might think that it is difficult to find a project in the current economic condition. Anyhow your husband started working there should not be any issue. You can join another company after 6 months.
Yesterday, I was told by the client that my project is going to end by this month end i.e Apr 30. Actually it was supposed to go for the next 2 years. I am currently in the project working for the project. They said the lay off was becoz of budget issues. But I see I am the only one that is target in this lay-off. I am working with the same client for the past 3 years. The lay off news was really shocking and devastating.
I am currently 9 months pregnant. As the client did that to me, I thought that atleast I might have some options with my current employer. My employer is a desi consultancy. I never been on Bench for single day for the Past 6 years ( Day 1 that I entered into US to till now).
When I spoke to my employer today he gave me a termination letter stating that my project end date will be my last date with them. It was more shocking. I will be on maternity leave anytime in month of may depending on the delivery. I don't see any possible options that any client can take me into project when I am in 9th month of pregnancy.
As my husband is doing consulting, I filed the green card thru this employer, 485 is pending more than 180 days, 140 approved in EB2 category. We paid all the attorney fees and filing fees from our pocket. We spent nearly $10,000 for the GC process. My husband was on bench for the past 2 months. He got a job on EAD which is going to start next week.
1. I see that my employer is terminating me immediately because he can avoid maternity expenses. I told him that I will take 3 months FMLA for unpaid maternity leave from Apr 30th. And look for the Job immediately after delivery and get into the Job. But still he is telling he won't provide me that time. Maintaining the status is very important for me as me and my husband depends on the EAD.
2.My medical insurance is with my employer, If I get laid off in this critical situation, I won't be having insurance. We can't afford the delivery expenses without insurance.
3. Even though my husband will get insurance with the new company, We are not sure that company will cover the pre-existing pregnancy that is in final stages.
4. And also not sure that the insurance will be under the network of OBG/YN and the hospital I registered for delivery. His job is in different state but he will find out the options once he starts his job next week.
5. Does anyone think that my employer is discriminating the law? He is terminating me immediately becoz I am pregnant.
I am not sure whether he is doing the right thing but the situation I am in is the worst situation I ever expected of. Its lot of stress on me and my baby. We are unable to sleep for hour with all the tensions ahead. My husband's job is dependent on my valid status. If something screw up we both be in very bad situation. Sure, your point is very much valid. What I understand from the Freakenomics experiment and EB3I behavior with respect to IV is that only a few folks have the perseverance to go all the way from D to B.
Take 100 folks with C grade and give them the $50 offer for B. May be 80% will reach that goal. (I do not recall the actual results of the experiment).
Take 100 folks with D grade and give them the $50 offer for B. Ideally we should see 80% of folks improving their grade to a C (one level up). But in real life only may be half as much (40%) will actually improve their grades to a C.
Interesting experiment, and I can see that is how human beings respond sometimes.
However we are guaranteed something in return when we TRY to do what we believe in, regardless of the odds as we see them: the satisfaction of DOING something about it, and a real shot at getting what we want.
Easy to try it. Pick anything, literally anything about your life you want to change (from changing your job to losing weight to calling up your parents more frequently).
Then WITHOUT THE FEAR OF FAILURE, do something about it. It will either work out, which will be terrific. Or it won't... maybe you don't success at that job interview after all, or you still put on weight. Even then, the satisfaction that comes from having TRIED is yours to keep! (Personally, I have found this to be more motivating for trying those things again, as opposed to the hopelessness that results from not trying and then seeing things not improve.) And of course, since failure is only one of two possibilities that there can be, you do succeed 50% of the times that you try honestly!
In case of IV's efforts including the upcoming Advocacy Day, that is exactly how I feel.

Counterproductive? what are you talking about. If they want they can approve 25000 cases in one day. It is nothing to do with productivity. Its all plain politics.

While I am happy for you and your success along with your spouse, I personally consider it as being at the right time in right places making decisions that were in your reach. I do agree that you did lot of planning. Most of the people here run on one income and spouses on H4/F1. So they dont have the edge you had/have. I might sound harsh in saying this but the matter of fact is that the 2 incomes lead to savings which lead to buying a home(s). 1 income, you wouldnt have done all these by yourself. I know several people with 2 incomes and most of them have done this :) Those who havent were the kind of folks who are happy having their 100K in bank rather raking up 200K in equity. I am sure there are a lot of things you can do with a US Citizenship.

Thanks Kumar1 for letting us know the options. We both have valid EAD's in hand. I like to maintain the H1B status as I am the primary applicant for the GC.
As you said some of friends also mentioned the same about talking to lawyer. Only thing I expected in this time is peace of mind. This is the worst timing. We always wanted to welcome our baby with lots of joy and happiness. But this desi consultancy put me in this worst situation I never expected.

I think most important things you need to consider: (Considering the fact that PD will be pushed back to stone ages in September Bulletin)
a) Hope that your I-485 Application is not approved before your PD becomes current. If this happens, it's a royal screw up until your wife keep's her own status (F1, H1).
b) Earlier, it was predicatable when your PD would become current and it allowed most of the folks to add their spouses at later time.
c) Bigger question is whether they would process on the basis of PD or RD. I think it's unfair to do it on basis of RD as most of the people would be jumping lines. Currently it's done on the basis of RD, but USCIS might change their SOP because of this July VB Fiasco.
d) As others suggested, make sure to maintain your H1B status as long as possible without invoking your EAD. This way, you can continue to keep your wife on H4 status (Unless she can keep her own status for atleast another 2-3 years).

Yes, I used nycgal's and made little modification to the intro part. Picked up the IV intro from our home page. Also emphasized on the skilled-immigrants rather than just legal immigrants. Still need to send it to Mr.Sturgeon.
