    Dear Nixtor, we should not question that when they do not have IV on their site and they do not cut us any checks. It is their site and they can architect it the way they can. Yes, the Indian Express misquoted Robinderi or may be it was a misrepresentation, we would never know but the good thing is that he has acknowledged the discrepancy. That is where it ends. Robinder has been a very highly regarded ananlyst and a commentator of indo-us relationship. We needs friends with him and not make enemies. It is a different thing that he is associated with USINPAC and we do not agree with their agenda, approach or the way they misrepresent themselves to be the representatives of Indo community in USA. We have about 2.5 million Indians in USA of which about more than half a million are stuck in this green card mess. Any organization that claims to be a representative of Indian community should have this Green Card reform as a very top priority in their agenda, but it was extremely disappointing for the people fighting for this cause when they approached some of these organizations who could provide just lip service and press releases from their chambers and project that they are on the top of the issue and working hard to get the work done. IV has filled this void for a true grass roots level organization with a huge membership base which is truely global,not just Indian and working in an extremely organzied fashion. I am sure that many of the the organizations envy the way we have built the membership base ( we are not a paid membership org) and have individuals roll up their sleeves, go to the fields across the country and work for this noble cause unlike others who are limited to doing press releases, photo opportunities and advertizing to promote them selves.

    At the end, time will tell if Immigration Voice would be successful in the agenda it has enbarked on, but what ever the final result be, our efforts would be analyzed for years to come by the ethnic, minority and national groups as to how to unleash the power of the Internet to build and run a grass root level oranization. Can you imagine how it would have been if Internet were available at the time of Mahatma Gandhi? I am sure Robinder has been thinking and analyzing that and we would welcome his analysis.

    I am neither questioning any one nor asking any one to have us on their website. If any org all of a sudden starts giving us more credibility or negative publicity ( I am not referring to USINPAC here, So do not mis construe my point again) I will definitely take a moment to retrospect and see if there was a common goal. If there was a common goal indeed, why we have not worked together? I just pointed out the feelings some people on this side of aisle share. I threw them out there, while others chose not to. I just looked around and why any one is supporting now and not before. Hey, Never late than now. I, personally am more than willing to know why the American Indian Citizen community has always ignored this heavy weight issue, especially when the drums beat heavily on how to retain the culture.

    * No. 1: Go around Sen.Menendez who has a "hold" on H.R. 6633, the "clean" E-Verify re-authorization bill passed by the House. Sen. Reid can bring this back-room filibuster to the Senate floor for a vote. If he does this, there easily will be the 60 votes necessary to stop Menendez and allow an overwhelming majority vote to pass H.R. 6633. (Reid reportedly doesn't want to do this because he doesn't want to force some of his Democrats to have to go on record just before the election.)
    * No. 2: Avoid a vote altogether by talking to Menendez privately, persuading him that what he is doing is threatening the reputation of the Democratic Party just before elections and get him to withdraw his "hold" on H.R. 6633. (This way, Reid could then bring H.R. 6633 to the floor in the "hot-wire" fashion which will pass by voice vote.)

    Either way, the American worker and public wins. It is all about Reid doing one of those two things.

    If you don't take the hunting class, I highly recommend a firearm safety class. Almost all firearm accidents are caused by human error and there are many technicalities you need to know (e.g. what to do if the cartridge malfunctions or fails to fire) to not endanger yourself or those around you.

    I recommend going to a nearby firing range and renting some firearms at the range and trying them out. You have a better chance of finding handgun rentals than long-gun rentals. The range will likely only ask for your Driver's license and will make you take a safety exam before they let you loose on the range. The experience at the range will help you determine if firearm ownership is right for you (noise, recoil, etc.). Go with a smaller caliber and a heavier firearm for a more manageable recoil the first time.


    Good info. From the pamphlet it is clear that if you have resided in the State where you are buying the handgun for 90 days and intend to make a home in that State AND are in possession of a valid hunting license or permit lawfully issued in the US the you are eligible to purchse a firearm from an FFL to possess in the US.

    I checked the GA Department of Wildlife website and you can get a license online for hunting in a matter of few minutes by paying a small fee unless you intend to hunt Deer for which you need to undergo hunting course.

    Hi,

    I need you advice.

    I have Labor and 140 cleared under EB3 (worldwide) and waiting for 485 to file. PD is December 2005. I am software developer/engineer

    I asked my company lawyer to file for EB2 since EB2 is current. This is what their response is.

    "DOL has come up with what they consider to be job classifications and separated those into the job zones. There are very few which make it to zone 5 and they include such things as surgeons, lawyers, physicists and the like, in other words highly specialized positions requiring a higher than normal education path and many years experience. There are no computer related positions listed under Job Zone 5. All our positions fall under Job Zone 4 which does not lend itself to EB2 filing. We can�t file under EB2 due to DOL restrictions to minimum requirements for positions."


    Is it true that computer professionals now can not file for EB2? Is there any way that EB2 can be filed? Is it not possible?

    No.. You can file under EB2? I dont know where you hered that from, my friend is about to file his EB2 he is in his advertisement stage.

    Second thing.. Who told you that the EB2 is current, EB2 is sitting at 11 Jan 2003 and for 5 months now. No body knows when will it move and how many days it will move......

    Even EB2 NIW is also in the same situation so how is your lawyer saying it is current. I guess you are lawyer is a barber.

    It's inevitable with so much unemployment there will be a rise in crime. Best thing to do is to install car security alarms, be wary of strangers and stay away from shady places. Of course can't help if you live in the deep south or the crime ridden NJ area. You are unfortunately a victim of your richer brethren of the same color who like to display wealth in their Mercs/Bimmers/Lexuses and who's women look like jewelry store mannequins (minus the stats of course :p) Sad story, can happen to anybody, anywhere

    1. Is this true, if
    a) your AP is valid, OR
    b) if your H1-B has a valid visa stamp and you didn't use your AP

    ie, basically if you have other valid documents to enter the country back, is the application deemed abandoned?

    2. Which "application" is deemed abandoned? Application for obtaining the AP or the I-485?
    => This is a good question. I also got confused about this. Looks like its I-485 not I-131

    LOA...means I am still employed without benefits ...at my old company.
    what you said makes sense..this is how I am looking at it

    -join new company
    -donot send in ac 21 paperwork
    -if i have rfe send in paperwork from present employer which will only be a generic letter----(i don't know how much detail uscis likes)
    -the reason i want to do LOA is that this way i will be sure they will not revoke i -140
    -what do the gurus feel ?

    I think your plan may work out just fine. I would make a couple of suggestions:

    1. If you are taking LOA from original employer, for practical purposes (for USCIS), you are not employed with that employer any more (they go by pay stubs). But if doing so helps to avoid revocation of 140, go ahead and do it that way.

    2. Because you will actually get your pay check from new employer, you are employed by them (and you will work on EAD with them, make sure that this is mentioned on your I-9 form). No matter how much ignorant your employer is, they will have to have I-9 on file and it must have your EAD (not H1).

    3. After doing this, you will be on I 485 pending status (no longer on H status), and so make sure you have current EAD and AP all the time.

    4. If something goes wrong with your I 485 (very unlikely); you will have to leave the country and enter back on H visa and work for H visa sponsoring employer (probably your old employer).

    5. It is perfectly fine to not file AC21. AC21 is needed only if you do not plan to join original sponsoring employer after GC approval. However, if you do want to file AC21, you do not need much documentation from your new employer. It just needs the simple letter stating your job position as a "physician" and brief job duties (briefer the better!) and salary (should be proportional or higher). If you do not file AC21, you may just keep that documentation on file with your attorney (which I would do to be on safe side). The implication of having this is as follows:
    --If you have this documentation (even if not filed with USCIS), at the time of approval of your GC you will have the option of just staying with new employer or going back to original employer.
    --If you do not have this, you will have to go back to original employer after GC approval with a "good faith intention of permanent job".

    You are correct. The rules must have changed recently. I wonder what made them make that change, Now children of US citizens (who were once Indian citizens) have an advantage over children who has both parents as Indian citizens. Weird.. isn't it?

    Damn..even our own Indian govt discriminates :( . Kids of parents with Indian passport are suspicious..

    I have 3 yrs degree + 1 yr PG diploma.
    But they won't file my GC in EB2 category, as I don't meet the 4 yr BS requirement.


    Here is a list of accredited institutions that offer online MS degrees at reasonable tuition:

    You can also consider getting a US bachelor's degree through online courses and credits-by-testing from one of these:

    If you do an official evaluation of the 3-yrs degree that you already have, it can be equivalent to up to 90 credits from a US School (which is equal to 3 years of undergrad education here). All these credits may or may not be transferable to the school/degree that you choose to enrol in. But you would have to research and find a school that would let you use most of them. That way you can complete your degree much faster than the standard process.

    Whatever you choose, make sure that the school is regionally-accredited by one of these organizations:
    CHEA: Directory of Regional Accrediting Organizations (2009-2010) (http://www.chea.org/Directories/regional.asp)

    My argument was on when your file will be looked at the first time. Of course, to get visa number numerous conditions, such as PD Currency, name-check, various documents, etc., have to be met. What I meant is that your file will be looked at the first time, only after cases physically received at the center reviewing your case (no matter what RD is shown on your receipt) before your case was recieved, have been looked at.

    Yes, I completely agree with your argument. It makes total sense. I was bothered by your observation that PDs cutoffs are not honored at all. That doesn't seem true.


    Thus, even if you name check is cleared, your PD is Current, and you provided all required documents, if there are cases physically received before your case was received (no matter what RD is shown on your receipt) which are still to be looked at (at least once), your file will not be looked at.


    Agreed with that. Your case may not even be assigned RD. There is a backlog there as well. And this has been further compounded by the July 07 fiasco. Folks keep arguing with me, hey this is a major victory for IVians. How so, may I ask? It has clogged EB3-I like hell. This has given USCIS a reason not to process it further and dedicate resources to it. Most folks who got their EADs, after being eligible for it out of order, have not even used it. It may have benifitted EB3 spouses of some folks in the short run but it has messed it up completely in the longer run. I'm not EB3-I but I can't help stating this.

    USCIS were very bad at calculating the size of the window. (Infamous July 07 is a glaring example of this one. How can you suddenly make everyone current? Beats my understanding completely!)
    They would suddenly raise the cutoff dates and have a big window. And then they would go by RDs within that window. So even if your case had older PD, it could happen you didn't get a visa number because your RD was of a later date and visa numbers simply got over by the time they got to you. Instead, they should have some weighted average of RD + PD, within a window.

    More importantly, they should NOT raise cutoff PDs dates arbitrarily. Hopefully, with the database revamping these administrative fallacies are corrected and such thing won't happen in future.

    I'd like to be able to say that those of us on H1B visas are doing the US a favor so we should get rewarded better for it, but I will be honest here and admit that I did not take up a job in US to be a good samaritan to Americans. I would be surprised if there were any H1B holders who moved to US just to do the states a favor.

    No, in fact I like many others moved to USA because I got an opportunity to advance my career and at the same time I am young and open to experience life in America and other parts of the world. To top that I love my company.

    Sure, I am helping my company and doing work that will touch the lives of millions of people. I pay my taxes. I pay my health insurance. I pay salaries to healthcare practitioners as I and my family needs their services. I pay rent. I shop. I keep money at my bank. You know, if you consider all that I must be a pretty good American resident. Smooth.

    Sadly there are some things that are not so smooth. My wife, who is a graduate from a US college and a qualified teacher with over 5 years of teaching experience in her home country, has no right to work here. I hear you say, US needs teachers doesn't it? She could get her own H1B visa.

    Life is not so black and white. It is difficult for her to find a compatible job in our area with an employer who could and would sponsor someone for H1B. She is chained by this. There are a myriad of teaching jobs in our area that she could fill right now if she had work authorisation.

    That is the #1 reason why I am now seeking a GC. If my wife could work there would honestly be no reason for us to want a GC except maybe when we reach the end of H1B time limit if we decide to stay here longer or permanently.

    We're legal, educated, and do things by the book. I'm from UK, my wife from Japan. That means just about every major country of this world is open to us (All EU, Japan and friendly countries like Canada and Astralia).

    We'd like to make US our home if we are welcome. Lawmakers, hear our cries.

    Could we have a poll for how many IV members are married and how many of those both got H1Bs? My feeling is that there is a very large number of H4 spouses suffering from not having work authorisation.

    Did you apply 485 in August 07 and already your status is showing pending? Did you receive a receipt notice?

    Please enlighten ?


    I have April 04 priority date (EB3/India). 485 received in Aug 07. The online status says 485 received and pending. What is the expected next status (whenever it will happen). For example, if your case (name) is for FBI Name Check process, will the status say something like that? What are the different status between receipt and APPROVAL(/denied)? Any experience holders???

    PD is the basic qualification and after that its all Luck .....Its a lottery ...

    That's about right hehe!

    But in all seriousness, like people here have mentioned - RD technically is important after a range of PDs become current. This is why, for example:-

    Someone with a EB3/ROW/PD 01/05/RD 06/05 (ie someone who got in right before retro hit) could well have received their GC in the last few months with the move in PD.

    As opposed to my case, EB3/ROW/PD 04/04 RD 06/07 and havn't got my greencard :) Both cases became current in the last few months, but obviously the one with the earlier RD would get approved 1st.

    There are ALWAYS exceptions to the case.

    But back on topic. What to do now that your I485 is applied. Spare yourself the endless agony by obsessively looking at trackers, or figuring out how signed your application for Fedex.

    I sound like a broken record, but if you are dissatisfied by this type of outlook - there really is only 1 thing you can do. I'll even buy you a drink in DC :)

    While this question may sound redundant, I want to make an honest attempt to understand it. How does creating media awareness translate into making politicians understand the complicated issues suffered by legal immigrants? Further do they give any weightage to the fact that the stories are in the media and therefore they need attention?

    I am biased towards the opinion that we might have already run enough media stories. I believe that the real fight now is to convince the politicians to do something about it. Propaganda and lobbying is the only thing that works with politicians in this country. And you have to choose a medium that politicians directly refer to. Meeting politicians and their representatives in person is most effective I believe. With due respect to your views, Pappu, can we discuss some of these questions?

    Is it not possible to make the copy of the application when you have to sign it? Will the alien # not be there on the application?

    Forgive me for my ignorance..

    I-140 is signed by the employer, not the beneficiary (employee/applicant).

    From what I have noticed it comes out on the 1st or 2nd Monday of the month.

    If the 1st Monday is in mid-lower single digits then it comes out on the 2nd Monday...

    Going by that trend it might come out next Monday the 13th.
