Yes, I got a CD from USCIS with all my I-140. I requested for copy of I-140 approval notice corresponding to I-140 tracking number SRC.XXXXXXXXXXX. This is the same number I got from my employer for online tracking on USCIS website. It took over 4 months. I submitted this as soon as got approval on my I-140. If you dont have the tracking number, you may try to get your A# from employer or attorney. You can use the same reason that you are changing address or that you need it for visa stamping. I believe they ask for A# in visa interview form.

You want to bet with me on this.. I am not wrong here. Why would I scare someone..Even if this is Misdemeanor or felony charges irrespective of wheather this is state or federal it is one's record and every officer at POE has an access to this record.

The reason I suggested sending in our credentials is beacuse the key in reverse brain drain is also "brain" along with "drain".
If we send in copies of our credentials (respectfully, in a nice package ) along with a stopper it will show them what they are going to loose.
Even to hard core right wingers it will show them that even if they neglect the human factor (caused by the in ordinately long delays) they cannot neglect the intellectual factor..

The issue at hand is not to "prove" if you are educationally qualified rather long delays in legal employment based immigration. So sending copies of degree certificates may not convey our message.
Stopper is a good idea because it weaves two ideas very effectively:
- Stop American jobs from off-shoring : use a stopper
- Stop reverse brain "drain" from America to keep America competitive : use stopper
This concept of reverse brain drain is well documented by the recent Kauffman foundation study http://www.kauffman.org/items.cfm?itemID=906
where they mention that 100K high skilled immigrants have left US to go back to India, China and other countries.

H1b and Green cards are allowed to have out of country stays. so if you are out of country for less than six months, it may still be considered as continuous stay. the intent of writing the word "continuous" is to declare that at any point, the immigrant had no intentions to leave the country and relinquish his immigrant status. for the legal immigrant, that should be acceptable.
Looks like it is for illegal immigrants as it asks for continous stay. Most legals would not have stayed continously as they might went out of country for vacation

I filed mine in July and still dont have the AP renewal yet. Its coming close to 90 days. does anyone know what I can do after the 90 day period to get my AP? is there such a thing as an interim AP or an expedited process after 90 days from the notice date?

Why don't we all campaign to ask for a time out on all immigration. Just stop all immigration until it is fixed. :D:D

Why not simply ask for approving in PD order.

One of my friend asked Shiela Murthy and she said that in order to be able to add my spouse , I would have HAD to get married before July 31st (which I couldn't anyway), because, then, only I/we will be eligible to add my spouse.
Also, I sent in the papers for my I-485 last night. Now, hoping to god that there is an RFE on this and some kind of delay.

To summarize the INS position, as long as the principal applicant gets married prior to the INS' approving the I-485 application, there should be no problem for the dependent/s to either file the Adjustment of Status, if in the U.S., or to "follow to join," based upon a consular interview abroad. Therefore, the principal can file the Adjustment of Status application prior to marriage, but the marriage needs to take place before INS makes its decision on the I-485 application.

Is the following (or can it be) a part of the Admin Fix Initiative? :-
Allow I-485 filing and/or obtaining EAD,AP benefits when I-140 is approved irrespective of priority date being current. This will help many of us who missed the July 07 boat.
After listening to his crystal cut views about fixing broken immigration system, my confidence level is boosted and felt like Dr.Obama has guts to deal this challenging CIR initiative for the better future of immigrants and for families of all of those hardworking smart legal immigrants who have been waiting for approvals from past 10 years. Hope it's not alluring speech for his upcoming elections. Problem clearly persists with politicians who don't like our EB VISA applicant community.
I think these following things should be the high priority items for IV core team and to all of us. People who have been patiently waiting to file for 485 since JULY 2007 are loosing hopes based on ongoing immigration trends. I think that it would take at least another 2 or 3 years to pass the CIR and to see it's law in action if GOP fellas have guts and to let this pass it successfully. I think that we should focus on two things to minimize the damage to our personal and professional lives.
I think one quick solution for fixing the issue of century old broken immigration system of USCIS is by allowing disciplined and long waited legal immigrant applicant to file for 485 application once his/her (I-140) application is approved. (Technically, I-140 is the real application for employment based green card. It makes sense for allowing applicant to file for AOS application (I-485 for personal information). this is justifiable with the current USCIS practice as USCIS doesn't approve his/her green card even if his/her PD ( Priority Date) is current unless they have visas to allocate for the case, so it should make prefect sense for 140 approved applicants to allow them to file for I-485)
Another thing is about huge EB backlogs for this broken system , that can be fixed temporarily by supporting and passing the recapture bill which allocates visas of those unused and wasted around 400K immigrant visas of last several years..

2. Meanwhile some people start getting FP notices and one does not receive them he or she gets anxious. Finally one gets FP.

8. Its almost 15 months since the first FP and one receives the second one because "Finger prints expire" ,
One has to repeat these steps in a cycle for almost 6 to 10 years depending on PD and "Nationality"
Meanwhile if USCIS changes any processes anywhere in the pipeline expect further delays.
I think best thing is to do participate in IV activities.

Let us say USCIS has unused visas, which they want to allocate and they have moved cutoff dates to Jun, 2006 for EB2, similarly Sep 03 for EB3.
My question is, will the visa issuance would be in the order of Priority Dates? or Notification Dates? Recently there has been lot of pressure on USCIS to issue processing results based on Priority Dates, will this force USCIS to correct its ways and issue visas based on Priority Dates.

I alos filed EAD renewal and Receipt came very fast. within 7 days. However when I enter case# on USCIS website, It says Case not Found
Do I need to worry about it ? Or Need to wait for couple of weeks?

On the uscis case staus site one has to type the receipt number which is either a SRC or LIN number. Make sure u dont type the hypens.
If u are typing correctly then just wait for a few days. Dont worry.
Last year we did see that there was a huge delay between actual check cashing, actual physical reciept in hand and the USCIS site was not updated at all. Happens a lot of times. Give yourself about 1-2 weeks and call USCIS.

If point sysem is introduced the big losers are immigration lawyers as they cannot make money in multiple stages. So no wonder if they oppose. Of course there is some limitations but its sucess depends on rules and regulations. Also there is going to be a Cap and there is going to be a provision to prevent displacement of US workers as the worldwide demand is always here. But main advantage is it will bring down the work load of various agencies like DOL and INS also employers.

What makes you think that an organization that cannot process 140K applications per year can handle millions?
