    Let's say, I am not able to do that. But, do you suspect that they might APPROVE my 485 BEFORE my PD gets current? If they don't then, I am in no trouble, isn't that right? If they don't approve, then, I can add her into AOS when my PD gets current again assuming I don't file for EAD (I won't - I like my employer for now).

    Friends, my AP renewal was received by TSC on June 7th (the receipt notice says that), but the on-line status check still says Initial Review. Any body in the same boat waiting with a June 7 receipt date still pending/Intial Review? Or has your case been approved as of that date? Please let me know.

    You are suggesting how to avoid it rather then try to acknowledge that there is a problem in the wording of AP. By problem, I meant the whole dynamics has changes over the years, so, its time they change to reflect today's reality.

    There may not be everyone who would continue to be on H1 while their AOS is pending.

    In light of the AC21 provision, this is pretty common - people change jobs using EAD and are then on AOS. Looks like the wording on AP was ignored when AC21 was being made into law. This is now biting some of the travelers.

    Could the AP wording be changed using an administrative fix by USCIS/DOS rather than a legislative update?

    When I called TSC this morning, the automated voice gave the good news - our GC were finally approved on 11/4 after a 7 year wait. Online case update shows the approval, but 140 status still says received and pending.

    Congratulations! How come it got approved when your dates are not current?

    Are you sure that you would get back what ever you paid for the policy?. LIC in India is different story than western insurance companies.No Ins. company gives back what you paid on whole life, Please make sure how much you get back when policy matures.

    Resolving the BEC problem is definitely one of IV's main goals. There is no way I will believe in DOL's claim of clearing all the back logs by Oct 2007.

    IV has had a number of discussions with lawmakers and administrative officials, first to understand the issue and next to solve it. There are two ways to solve it. From our discussions, it has become clear that the lawmakers still view this as a temporary problem and are not willing to legislate on that behalf. Never the less all of them did agree that the efficiency of the BECs left a lot to be desired. So we were working a bi-partisan coalition of lawmakers who were willing to put pressure on DOL and USCIS on the need for efficiency and transparency.

    All of this was before the crazy pace with which the Comprehensive Immigration Bill began to move. We do have to realize that this bill is a golden chance to have our provisions in place and we have less than 2 weeks to works on it. Frist wants either of the Immigration Bills to be passed before Apr 7th. If we do miss out on our goals in this bill and this bill gets passed, we will not be able to revisit our issues for a long time. So right now a lot of the attention is being given to it. This does not mean that BEC is forgotten. Hope you do understand.


    I appreciate all that the more active members at IV are doing for BEC resolution. A sincere thank you.

    My posts were aimed at addressing the naive belief among a few members that the BEC mess is a non-issue. The IV community, I am sure, realizes that the BEC mess needs resolution. I do not think that IV has forgotten BEC issues; it wouldn't be one of our goals had we forgotten about it.

    Of course, different issues are to be highlighted at different times, depending on tactical necessities. So it is only appropriate that the current focus is on the bills. Those who are intimately and acitvely involved must of course set the priorities as they see fit.

    I am sorry that I wasted my time searching information for you. You just wanted to rant and are looking for a shoulder to cry. You are not serious about reporting your employer to DOL. It is foolish to expect idiots like you to come out of the gutter because you just enjoy the smell of the gutter. Expecting that your rants will have any affect on people who take advantage of immigrants is extremely foolish. And expecting folks like you to stand-up for yourself and do something about this is even more foolish.

    One more thing, only desi consulting companies are not the problem. Companies who figure out a way to take advantage of its employees, will do so. All companies are in the business of making bigger bucks for its shareholders. If they can figure out a way to make more, they will, even at the cost of taking advantage of immigrants. Desi companies figured out the loop holes first. Some of the other companies followed, others are still learning. It can be argued that % of such elements in desi consulting are more because they were the first to figure out the loopholes. But desi companies are not the only group taking advantage of immigrants. They are all the same. And folks like yourself feed into the problem. So please stop blaming just the desi consulting companies, because all companies are the same. Some companies have not yet figured out the ways to take advantage of immigrant employees. But these comapnies are learning fast, because they want to be competitive, right?

    The actual problem is, the Congress. Lawmakers are the problem. They know everything what is going on. They know that not just desi companies but even larger companies take advantage of the vulnerable part of the society - the immigrants. Inspite of having all the information, the lawmakers deliberately did not add necessary protections for immigrants. And, even if the system becomes more efficient, people who enjoy the gutter will continue to live in the gutter. No laws or protections can help folks like you. Every now and then, just come to forum like these and rant once in a while. That's what you will do. The fact is you do not need better treatment or benefits. You need better therapy to tell you that you can come out of the gutter.

    Please stop ranting and stop "requesting" desi companies on forum anonymously.

    And always send via USPS express mail. (1 day costed me $18) but I came to know instantly the next day that they received it.
    You could also use some cheaper USPS option. as long as it has some delivery confirmation.
    The reason I like express mail one day, is because u can request a copy of the receiver's signature via email (comes in a PDF). This is proof that USCIS really got it and u can then sleep nicely for the next 3 months.
