To be honest, I do agree that the US needs qualified people with skillsets. The real question is "Are the people from the desi consulting companies the real qualified lot ? " Just to get my background details out of the way. I am a new member, from India ofcourse, and I have recently applied for my citizenship. Now with this huge deluge of immigrants, especially from the desi consulting companies, I feel that my quality of life is getting adversely impacted. Do not rush to conclusions that I am anti Indian or anti immigrant. 12 years back when I first got my H1 visa, the requirements to qualify were strict. Staffing companies to a decent extent followed rules and tried to get the best and the brightest. Once the dot com boom started, people from all walks of life entered IT. This was true of not just the Indians but also of people in the US. Soon after the bust, the value proposition from these staffing companies was simply low cost. This is not to blame the staffing companies. They behaved in an economically rational way.
Consider this scenario. If you run a consulting company, wouldn't you try to maximize your profits by staffing people in projects at the least cost ? This is econmically rational. You wouldn't worry much about the quality of the deliverables and all you would care is to dump as many bodies as possible at the client site or offshore and get the maximum bang for the buck.
In this scenario, how is it feasible to expect immigrational justice when the bodies themselves dont provide exceptional talent and skills but simply offer low cost ? Now you would be tempted to bring in the analogous case of illegal low skilled immigrants. Remember they are just that - low skilled workers. They dont "steal" the jobs of high skilled workers. But this dumping of IT workforce has completely brought down the standard of living of the IT workers here. To be honest, those who get green cards today would feel the same way five years from now when the next wave of so called "skilled IT immigrants" offer even lower wages and destroy the quality of life.
In summary, this retrogression is good in a way. The truly best and the brightest would still be employed until their turn for adjournment comes in. Only the weak are currently scared of the delays. I went through the same torrid GC phase after the tech meltdown in 2001. I was not worried of my job then but many people whom I knew got clobbered and were forced to leave. This is the darwinian flush and it will take its toll. Trust me this the bitter truth. If you people still consider that all the people on H1/L1 are part of the best and the brightest, they are WRONG. Only a small % (probably 20%) are the true best and the brightest and a good 50% will be flushed out. Sorry to say this and hey give me the red dots.

Get your facts right first. India is not actively supporting Sri Lanka. It would be suicidal for India (especially considering nutcases like you that exist) to even think of that again. Sri Lanka is using Israeli UAV's and Chinese fighter aircraft and artillery to fight the LTTE. In fact, India is at a strategic disadvantage now because we choose not to help Sri Lanka militarily. And in fact, Sri Lanka has always suspected India of supporting the LTTE. Read about the "string of pearls" geopolitical strategy of China before letting your emotions run crazy.
India can leverage its power to stop Sri Lanka to fight until Tamil civilians are cleared from the war zone but deliberately India is not doing that.
India rightfully doesn't care about the LTTE. LTTE is a terrorist organization. Period. They killed a former Prime Minister and it doesn't matter if you support the Congress party or the BJP. This is beyond politics and concerns the nation. The primary humanitarian issue in the conflict so far has been with Mullattivu. REALLY? Is it a coincidence that a desi company owner will usually have 99% of his emploees Indian? Thinking that employment depends only on skills is not realistic. A lot of the networking based on national origin interferes with how at least H1 jobs are landed here. So there is a reason to have rules preventing a monopoly.

Application for 1 person:
1. Lawyers fees = $500...............paid by me....not sure if any paid by my company
2. AP+EAD = $350(170+180).....paid by me
3. I-485 = $395..........paid by company
6. Fedex = $60...........paid by me
7. Medical = $170(no shots needed except TB test)....paid by me
So all i all I paid $1080 and my company paid atleast $395(and maybe some legal fees too)
And belive me guys I am at the lower threshold since I did not need any shots and did not loose any work days........
So minimum loss to the company and individual(1 pesron only)is atleast 1475 bucks. So before making any conclusions keep this as the lowest threshold.However since we might get the $395+$350 back so the net loss to the individual at minimum will be $730/person and maybe $500/person to the company so making it atleast $1230/for 1 person.
Assuming that appx. 45000 people were planning to apply....I guess we are at minimum $55350000 loss......and this is a very modest estimate......as I mentioned at the lower threshold.

I hope this is not our last ditch effort or one of the last chips in our possession to further our goals of Greencard.
The crisis in united states is not just housing bubble but much more than that. I am not sure if this initiative (linking greencard and purchasing home) will find much traction in government or in medai given the complexity of the mess.
The currency collapse which we used to discuss is now gathering storm now. The recent runnup in Dollar is peaking now and is in downward trend. Analysts are already up in arms arguing that United states have to take massive debt (assuming China and arab world is ready to give) or they have to print currency to finance their bailouts.

What I understood
If you are on H1 and is validity more than one year. Keep continuing. Once expiration is withing 6 month , start finding the direct vendor. Make sure you start the process early. So that even if it rejected you have time to jump to direct vendor. My two freinds got victims of this rule recently this week only .Their transfer was rejected for this reason , Now they got the offer from Direct vendor , H1 trasnfer is in process . EAD should be unaffected by this memo.
There is no doubt Small Desi co. given fair chance to all kinds of people from remote villages. Then again they took unfair advantages too. Its time to wrap up their business now.
Situation is alarming indeed.

I'm on H1 and I also bought a house 2 year ago, though would like to sell my house , it's a great idea as I can sell my house easily if that strategy worked out. Then I can buy a house again in order get a GC quickly. ;)

I dont understand the whole point of discussion here ... What does the IV Senior Members think about this , The idea of a lawsuit to capture the loss immigrant visas, is not against USCIS, its against the system. Infact the USCIS should be on our side, as per the USCIS Ombudsman, Mr .

VICTORIA � The BC Liberal government finished its fiscal year with a significant surplus, which helped fund a record investment in public infrastructure and lowered British Columbia�s debt, Finance Minister Carole Taylor announced with the release of the 2006/07 Public Accounts.
The audited financial statements show the Province of British Columbia ended the fiscal year with a surplus of $4.1 billion. The surplus, along with a drawdown of cash balances, allowed the Province to reduce debt by $1 billion and finance a record $3.4 billion investment in building and upgrading schools, universities, colleges, hospitals, roads and bridges to improve services and meet the needs of a growing economy.
�A big surplus means a big investment in our future,� said Taylor. �We are building health care facilities to meet the needs of an aging population, we are upgrading transportation networks to keep our economy moving, and we are expanding post-secondary spaces for our youth. Our surplus allows us to do this and still reduce B.C.�s debt.�
Taxpayer-supported capital spending increased to $3.4 billion in 2006/07, up $265 million compared to $3.1 billion in 2005/06. Over the past three years, the Province has delivered $8.8 billion in taxpayer-supported capital spending while simultaneously reducing debt.
�In 2006, the budget planned for debt to grow by $1.7 billion to help finance public building projects,� said Taylor. �Fortunately, we were able to use the larger-than-forecast surplus to both pay for these projects and pay down debt by $1 billion. Building our province and reducing debt are investments that will generate benefits for years to come.�
This is the third consecutive year the Public Accounts received a clean audit opinion from the Office of the Auditor General. The Public Accounts meet the standards of Generally Accepted Accounting Principles and fully consolidate information from school districts, universities, colleges and health authorities (SUCH sector) in the province�s reporting systems.
In addition to the Public Accounts, the Province also released its Ministerial Accountability Report, government's annual strategic plan report, and annual service plan reports for ministries and government agencies. The Ministerial Accountability Report details the fiscal and other accountability targets ministers have achieved. Service plan reports summarize the progress of individual ministries and agencies, as well as the government as a whole, in meeting the performance targets laid out at the beginning of each fiscal year.

I don't think so. 7% limit has been there for a very long time. Unused visas from prior years for ac21 purposes were still subject to 7% in current year. The 7% rule was unchanged.
It seems that you think that the unused visas from prior year were not subject to 7%. There is nothing of the sort that allows this.

This is the section that allows for the 7% cap to be violated in case additional visas are available.................
This is the one many anti immigrant people tried to get removed again and again......
USCIS did not do anything wrong in 2005 nor in 2006.....By allocating additional visas to India/China USCIS did not do anything wrong...You can sue them ....USCIS has good grounds to defend their position.....You would not get anywhere...

Once u sent ur application, did nt u have to go for an interview and then a Physical. Also, I have heard that to get PR stamped onto ur passport, u actually need to physically enter Canada. Kindly confirm?
I did not have interview. I had my interview waived.
Once all the processing is complete, they will ask you send you the passports. They will give you PR visas which will be valid untill 1 year from your medicals. You have to land before the visa expiry dates.Once you land in Canada, they will take a Canadian address to send the PR card to you. You can give friends address in Canada.

Met this dude once in a grocery store, he and his hot wife gave me the amway speil. I said listen buddy give me a time to visit your house and number. I called him and we played phone tag, one day I called and his wife picked up, i ASKED IF i could come, she was hesitant and said he was out of state for a conference but I convinced her that it's ok. When I arrived I brought a bottle of wine and then she was all over me in 5 mins. Sigh what a wonderful time....
