I have a question which I have been wanting to ask for a while, so if GC is for a future job then can someone incorporate a company and work for self on EAD/AC21. If there is query for ablity to pay then at that point can you have an offer from other company and work for that company for 6 months once you get 485 approved.

As long as the person married before I-485 was approved follow to join can be availed. it can even be used after I-485 is approved. In case of kids the birth has to be before I-485 approval.
The only problem after I-485 approval is that the dependents have to wait in home country for processing and cannot come to USA to file for AOS. It does not take as long as FB though.
Visa number availability is determined by the primary's PD and the visa bulletin published by Dept of State.

Thanks for the quick reply. I was reading that getting approved I129 means you are cap exempt for next 6 years. As the petition for visa was filed in 2007, so according to this cap exemption should be for next 6 years i.e. 2013. Would be really nice if you can clarify this.

After waiting for a year for my FP notices and 4 SRs later I guess I took the infopass and went to the local office. The guy out there was quite nice and helpful and gave me the appointment for next day at the local ASC promptly.
Went to the local ASC and was was done in half hour. No issues.....it was a breeze...shd have done it sooner....
And here is the best part: My application had an LUD just 3 hours later.....

Not sure if I posted this on right forum....
I'm at 485/EAD stage. not on H1b anymore. I recently badly sprained and fractured my ankle/foot. Am considering taking a leave for maybe two weeks from work.
Question: does going on short term disability and getting benefits from the state have any adverse effect on the immigration process?

Hi,
I graduated on May 2008 with an MBA degree. My OPT started in Jul 2008 and is valid till Jul 2009. I am not eligible for 29month extension.
I was on an internship till Jan 30th 2009 and am looking for fulltime positions now.
I understand that I will have to file for H1 on April1st and I can stay in the US and work legally if my H1B is still in process under the cap-gap rule passed last year.
How long can I legally stay in the US on OPT without a job?
Can anyone please throw light?

I have no US visa stamped in my passport and planning to fly Emirates to India via Dubai. I will use AP for re-entry. Do I need transit visa at Dubai like London and other European Airports? Response from anyone with experience will be appreciated. If already discussed here, guidance to particular forum will help.

Thanks in advance for answering my question:
I have had an EAD from past 2 years, but I also had a valid H1B I was working for company A on H1 and my GC is filed by Company B future employment(and hence the EAD)
- Company A went down last year, so I was laid off, so my H1 lapsed.
- I switched to Company B since I have an EAD through them.
- I am on Company B's payroll currently.
- The company A folks needed help after they were shutdown, I helped and was paid for hours. (doing same and similar work) but not issued a 1099...
Question - I will need to file taxes on those hours, in terms of immigration have I done anything out of ordinary here? I don't know if USCIS and IRS connecected, or I am just being paranoid here?

As you are on EAD nothing wrong is done as for as USCIS is concerned. Just add that income as self employment income you should be fine. Also you can deduct those expenses you made to earn that income.

In the I-140, Immigration Petition for Alien Worker, under �Basic information about proposed employment�, in the �Wages per week� column it is written as $XX,XXX/yr.
Is this the amount my employer offered in the full time position that he offered while processing my GC?
Do I have to make sure my salary with new employer should be more than $XX,XXX/yr?
Also my original employer who filed my GC mentioned my designation as Software Engineer � Applications, Do I need to have same designation in the new firm? Or can it be anything under Software Engineering like design, programming, analysis,developer,data quality,testing etc?

As a July 2007 filer, you do have to pay the $305 filing fee. The $80 biometrics fee applies only to applicants for Reentry Permits and Refugee Travel Documents. It is not required for Advance Parole.
Individuals who file for AOS after July 2007 have to pay a $1010 filing fee for the I-485, but are not required to pay filing fees for subsequent AP's and EAD's. The following is an excerpt from the USCIS website:
"Please note that, if you file Form I-485 to adjust your status as a permanent resident on or after July 30, 2007, no additional fee is required to also file an application for employment authorization on Form I-765 and/or advance parole on Form I-131. You may file these forms concurrently. I came to US in 2009 March (on H4 Visa) ,
I filed my H1B in September 2009 with Company A and got approved October 2009. I search for projects 2 months; my employer was unable to place me. So he said he will revoke the H1B petition. After that due to family emergency I gone back to India and while re-entering I entered as H4. (As per I-94 Copy). That H1B never got used and I never got any pay stub from Company A.
Now I am on H4 till date.
I have found the project and the new employer (who is client say Company B) is ready to file my H1B application. Now as per the Company B�s Legal Team, they can�t get the approval before 1st October 2011 (or start date of H1B visa) and they have to fill this position by this month End. (Which is May or Mid June)
Now I have inquired some other place and gone through different forums to get answer.
Here is the query,
If Company B files my H1B petition with attachment of existing I-797, will my petition get approved from the quota of 2009 (since I got visa with validity date as 1st Oct 2009 year)??
What kind of H1B petition I need to file and when it will get approved?
Will this be a fresh H1B petition or something different?
