Because of sudden influx of projects coming to India last year, there was a temporary upsurge in the demand for skilled personnel in india ....So there are many options for these people which caused the higher attrition as they have many options open....So temporarily these IT Companies used to retain highly skilled employees at any cost and kept them in front line and recruited some freshers (i have seen one company recruited freshers and charged them 50,000 ...you heard it right :0 initally with the commitment of 2 years).
As the freshers are catching up with the experienced ..i see a sharp decline in demand my area of expertise from past 6 months to an Year .... But from CEO point of view , still work is done ..with 40 % or more saving ..may be for little compromise on quality ....
I have a feeling that attrition rate may slow down in coming years .....
Any one please share your views /experiences ..

This is what I got from 4 separate lawyers when I was invoking AC-21. I think everybody should speak to a lawyer before invoking AC-21.
A lot of people out there think that after getting EAD one can invoke AC-21 to change to any job at any employer. This is not true. AC-21 is pretty complicated and I think that in the future, if there is no change in the law, a lot of 485 applications will be pending for 6-8 years or more. And for the duration of this period, a lot of people will invoke AC-21. I also think that the rate for rejection for number of AC-21 cases at USCIS will be higher. Nobody told me about the approximate wait time and rejection rate. It is just what I think based upon the developing situation.

i think this still upholds the memorandum with regards to porting off on unapproved i-140. if you notice the case they have cited "Matter of Al Wazzan" is date Oct, 2005 where as the favourable Yates memo came out in Dec 2005.
what i understand is that they are just reiterating that porting off on unapproved i-140 is not automatic and requires that the adjudicator decide on the pending i-140 first before deciding wether the porting off is protected under AC21 or not.
but again...i myself am waiting for clarifications from immigration law websites like murthy.com and immigration-law.com etc.

Our lawmakers are unaware of the issues that affect us and it is really upto us (each one of us) to educate them.
The most important thing that somebody can do for themselves is to take an appointment with your congresswo/man's office and talk to them. It is not that difficult. Just 1 hour of your time.

There are also appointments for H4 for Aug 3,6,8,10. She shoudl reschedule her appointment.

How come your case is assigned to IO inspite of pending NC. I saw a post which said that NC should be cleared before 485 approval. They are planning to finish NC by Feb, 09; for all applicants whose NC is pending for than 6 months.

I recant my earlier outburst at mercies since I realize that he was acting as a messenger to the problem. Sorry for the offense mercies.
There are many people who would just run away from effort when doubts are raised and since people of afraid of being punished for just advocating a public policy or writing a letter to congress in the first place. I would request you to not reproduce posts here or on portal that would echo the material the plants fear and doubts among members. When the core group is spending 2-3 hours a day on top of their fulltime job plus the weekends, plus out of pocket expenses on travel to DC, its disheartening when a post on forum scares away sceptical members.

I appreciate your words. I will be more careful about how to counter negative propaganda either myself or get help from others! This was clumsy and impulsive of me to post this all here, but believe me I have myself learnt so much more in this process!

Tired of waiting ( PD: August 2001) I finally wrote to both my local congressman and Senator today. My senator is on senate Immigration commitee so lets see what happens. Hopefully something will move.
If this doesnt help I will try Ombudsman next after couple of months. The Ombudsman form has a question of if you have tried through Congressman etc first so we can try and see that.
Guys its so funny when you see ppl with PD of 2003 and 2005 complaining and bitching. Here we have waited 7 + yrs our PD's are current and we are doing OK. Wait sure brings maturity :)
