What is the benefit of applying for an OCI card for the kids and how long does this process take?
the kid does not need a visa to enter India. Also, if you go on a visitor visa, then your stay is limited to 180 days at the max. On an PIO you can stay how ever long you wish to, but after 180 days, you need to register with the district police station to get a certificate of extension. this is usually valid for about 2 years. you can renew that every 2 years.
If you are on an OCI, then the above restriction on PIO does not apply. You have all the prvileges of an India citizen, except that you cannot vote and hold agricultural land.
I am not sure about sutdying at Indian citizen rate. You might have to pay the fees in USD, if i am not mistaken.

How can you judge God's intentions when you don't know Him? Can you prove that God does not exist?

If god exists , he/she should listen the prayers and save people.
This is just one example.There are millions of incidents which proves that GOD doesn't exist.
It's just out belief that GOD will do some good for us.

There are people from India with PD 2005 whose I-485's have been approved lately.
I don't mean to sound dismissive, but I don't count as being a reliable source of information, since it is a tiny minority of total cases, and all information relies on user input - not the most reliable set of data, imho.
On the 1st page of "Country = india" and "case approved" there is 1 case that applied this year (feb eb2 with a PD of 02) - they were lucky. Everyone else applied before retrogression hit in 05 with the exception of a couple of eb2 with very old PD (00,01). 2 cases out of how many? 100s of thousands?
sanjeev_2004 - I respectfully disagree with your statement that the "pending visa number" situation will no longer occur. It will happen MUCH more. The number of available visas has not increased, the number of people that have applied for AOS has dramatically increased (either old or new PD). The visa numbers will be QUICKLY used up by those with old PDs, so those with newer ones will sit for a long time waiting for visa numbers to become available for their PD - they will become "pending visa availability" cases.

Earlier it was 140K times 7% = 9800 with everybody and now it is 90K times 10% = 9000 with most of them gone into new merit based system.
I still don't get it?
Good Point! this is actually more visas for same number of folks. Approved or soon-to-be-approved I-140 folks (like me) will get GC on time or faster and others with Maters degree will get GC in 1 or 2 years, and rest must have got admission to MS by now. and there will be some loophole to bank on which will be realized by our stupid Joe after a few years.

I would only say "Hang On", or move on if you can. A lot of people in same situations, never want to discuss issues openly.
Patience does help, and maybe all the good is stored for future.
Most important is how you deal with stress associated with racial slurs, difference in treatment, and all the above issues. This has direct impact on health and many people in these conditions are victims of stress.
The h1b - GC situation is well known to everyone and they know you are indentured, some managers are called problem solvers (they pretend to hear ur voice, help you from their side and get the work done and try to ease pressure off you if they have an option), whereas some managers are called problem creators (they add additional pressure on you and make u miserable so that they get the work done). The reason companies support their American workers who involve in racial slurs is to avoid issues. It is easy to kick you out and blame you rather than catering to ur problem.
I agree with you totally. Being patient is a good way to take this. I have seen this happening at my work place too. But until we get GC we have to learn to handle this. We are 16 desi's in my company and my managers says that many "co-workers" are jealous as it seems that we are taking their jobs

I hope this CIR passes and I get EAD and I shall try to leave as soon as possible.

-join new company
-donot send in ac 21 paperwork
-if i have rfe send in paperwork from present employer which will only be a generic letter----(i don't know how much detail uscis likes)
-the reason i want to do LOA is that this way i will be sure they will not revoke i -140
-what do the gurus feel ?

In my opinion if you choose to use EAD, I think you will be very much fine with this route but with H1 transfer it will be tricky. You may have to go through 2 H1 transfer to come up clean legally. First H1 transfer to new employer and second H1 transfer to old employer again As you did not work for old employer for one yerar and hence no pay stubs and hence technically H1 dies there and so if old employer is willing "to hire again after one year" your old employer should file new h1 transfer and then you can come clean.
And during all this juggling make 2 things sure.
- You do not get promotion
- You do not get more than reasonable (10-20%) increment in the salary (The slary which was mentioned in your labor application)
Again before juggling consult the lawyer first.

Attorney said that they have represented Employer also along with the employee and hence they need an authorization from Employer in order to answer any questions or to do any thing with my pending I-485.
Either this is not an honest statement (or an excuse for not working on the case if you already paid him/her), or the lawyer is not competent. You are better off with a new lawyer. Simply contact another good lawyer. S/he will file a G-28 form.
