My current H1 is expiring soon. My 3 year H1 extension is pending. I had receipt notice but NJ DMV at Wayne refused to accept that. My current License is valid only till the middle of the next month.

Thanks for your informed comments. Like you, I am also surprised to find many people in this forum, who are interested in fire arms.
I don't own a fire arm and not planning to while the immigration status is not yet Citizenship. I don't want the authorities to give another reason to look into my case. I just go for fishing once in a while.
But our family owns two guns in India and have worked with guns from childhood.
Another point is I am very much impressed with how the Americans manage wild life and the nature in general. They enjoy it while preserving it. India does neither. We just destroy it, and write eloquent speeches on nature protection.
Federal law does allow H-1Bs to purchase firearms if they have lived in the US (Same residence, if you move, the clock is reset) continuously (if you leave the country, the clock is again reset) for 90 days and fall under one of the 4 exceptions listed below.
- Possess a valid (unexpired) hunting license issued by any state in the US
- Are a Law enforcement officer from a foreign nation, here on official duty
- in the US to participate in a shooting sports competition
- get a waiver from the Attorney General
The easiest of these 4 exceptions is the Hunting license exception.
Once you meet the above mentioned criteria, you are okay, per federal law to possess a firearm. Doesn't matter what non-immigrant visa you are on (H-1B, F-1, AOS).
Next step is to check whether your state has additional restrictions. I don't think any states completely bars non-citizens from possessing firearms (atleast none of the states that I have lived in do), although some states have restrictions on the type of firearms non citizens can buy. e.g. in MA, non-citizens (including GC holders) can't buy handguns or high powered semi auto rifles (ARs, AKs) but they can buy non-large capacity rifles and shotguns.
As someone pointed out, trying out guns at a public range which has rentals is a great way to introduce oneself to the sport, learn basic firearm operation and safety, and to try a wide variety of guns and calibers.

FP on june 28th, still no approval.
My current EAD expires September 24th and i am working on EAD currently.
Called USCIS and opened a SR on August 4th. Got a letter on August 11th, saying, although my situation is serious, i have not provided enough proof. Called USCIS August 13th, asking where i can mail the proof. Was told there is no mailing address and no fax number.
Scheduled an Infoapss Appt. for August 18th, by then it will be around 82 days.
Around the 90th day planning to meet my Congressman/Senator and hoping they could help me.
If some one can help me in finding fax number to TSC to send in my Expedite request it will be great.

IV is not just IV core but each and every member. each member should try to do something positive in order to help IV in whatever way theycan. - contributing money, help increase members, contact their local lawmakers and also contacting media. we need to raise awareness andevery small positive action done by an iv member helps in the overall scheme of things.

• The GC process involves Labor Certification (2-3 months) + I-140 (0-12 Months) + Wait for priority dates to become current (several years) + security checks (1 month to 2 years) + I-485 processing once priority dates become current (18 months to 3 years).
• Yearly green cards quota for employment based applicants is 140,000. This includes visas for spouses and children. So on an average; it is given to ~ 60,000 families.
• Country visas limit is 7%, with almost equal distribution for EB-1, EB-2 and EB-3 plus any unused visas from other countries. Generally speaking, for countries like India, approximately 7000 visas (~3000 families) were being issued every year in each of these categories.

• EADs are valid for one year and several employers (and rightly so) view it as a temporary permit and hence reluctant to hire you.

there is lot of chnace for those who got their I-140 approved, even their PD '2006.
you can see people getting approved PD'2005 EB2 cases, even then VB says now 2004'apr for EB2.They are not processing based on PD now and in future also i gues.Since we have already filed.PD will restrict only to File I-485 in future.

On a second thought, though, why then DOL said that I required 5 when I had MS plus 5 yrs of exp.? Did they interpret my 5 as including the 4 yrs attributed to getting MS?

PS: Also, if someone takes 4 yrs to do MS when it should not (exceptions health-related gaps) take more than 2 to 2+1/2 yrs, red flags may arise.

Thanks for all the inputs. I still have not received the letter ( probably because of winter strom - delay with traffic) .
Now if the Deniel is because of AC21 and 140 revoke , when we reply with MTR, should I sent copy of the AC21 letter we sent before or do we need to sent a fresh one ( employment verification letter ) ? The reason I ask this is when we originaly filed AC21 docs ( in Feb 2008) I was with Company2 . Now I am with company 3 ( just 2 months ). And good part of is company3 is well aware about the "same or similar " letter and is ready to issue the letter .

So what is the general feeling about the Original GC sponsoring Job, Should we continue the Primary Job and Start a company on the sides. In my case
1. I am not on H1B anymore
2. I am already using my EAD with my GC sponsoring employer.
3. My Employer is ok if i leave the company ( i have been with them for 6-7 yrs now and they have made enough from me...fair enough i think)
4. My employer will not revoke the I-140 for sure.
5. My client is ok to work with me if i start my own company.
All the above points make me inclined towards starting a company and work for it, Do you think it is not advisable to change the employer specially in the case when you are starting your own company..
