You can mail your I-485 on Feb 29. USCIS must receive it in March. I would suggest you to file your app ASAP in March, because you never know - dates might retrogress again.

EB2 India - PD June 2006
Currently on H1B and have I797 - I-94 until Oct 2010.
Visa Stamp Expired June 2006.
EAD approved for me and wife. My wife is using EAD.

If per Country Laws are removed in issuing Green Cards, then 90% of the employment based Visa's will be given to Indians and that too in the IT Sector.
Mostly the country will be Indians, chinese, mexicans . The Law makers don't want to colonize America.
There is a lot of stress that was done in making that decision

Ok, the guy that sets the dates says that he sees no possibility of dates moving forward for EB India and ppl are still thinking there is hope? I am an optimist and try to see the brighter side - and that side here is that we know there is no hope for those past 2005 in the next two years. That to me is sufficient to make decisions and move on. Be it changing to a different job or going back to the home country - most probably the former for me.

Canada immigration is simple & straight forward.
No expensive lawyers are required or any lengthy procedures. Just self do. Also look at the currency rate of US and Canada almost same... Tax is a little high but medical is fully covered.
You need to fill forms,send all your education, papers etc and LO ! you are done and get PR Card. Some of my friends got it in less than 2 yrs.

What can go wrong...many things can go wrong.. you do not know and many things cannot be proved.. With myself it already happened.. In year 2001 Bubble burst my then employer gave me a choice to move to Canada ( Exactly Microsoft kind of public declaration.. Company is also very prestigious and more or less you can consider it of the size of Microsoft).... I took decision not to go and so I was out of the company.. Some friends went there.. after 2 years laid off.. Those 2 years they got American salary on Canadian land (Dream, huh !!!!!!!!) ,, But then what after lay off.. One of them had to sit 6 months to get proper job.. Way less salary... Can this happen to everybody? May not be..But the bottom line is you will have to fiight out the hurdles.. Here you have GC Process hurdle.. In canada you may not have that but you may be having other 100 hurdles... What will you do then? WIll you go to Australia? ...There are 600 countries so at the most you can do 600 migrations :-) By the way both of my friends now want to come back to USA after getting citizenship and their families do not want to move as they have mentally fed up with this move from country to country.. I am surprised that this is even a headline news in TOI. SRK detained at US airport for 2 hours. So what? Big deal. TSA didn't ask him to sing or dance, but just questioned him on the purpose of his visit, which is part of their job.
US has got every right to protect her homeland and no one has got any right to question their procedures when it comes to national security. Because of such stronger measures there hasn't been a single terrorist incident in US since 09/11. The least we could do is to learn from them and implement such stronger measures in India, which by the way has become a playground for terrorists and anti social elements.

Hi there,
Here is my situation, any help to resolve this is appreciated.
- My self (primary) & my wife's(derivative) I-485's (PD June 2002) were filed in March 2007.
- My I-485 was approved in July 2007, my wife's was pending due to NC.
- My wife's employer filed PERM (PD June 2007) & then filed I-140 in March 2008.
- We recently contacted NSC regarding my wife's case status, we received a letter from them stating that, her I485 is waiting for I-140 to get approved.
They linked her new I-140 to her pending I-485 that was filed as derivative.Is this USCIS error?.How to correct this error and have them consider her I-485 application as a derivative application?.

Agreed this is discrimination, what stops us from fighting this discrimination using legal class action lawsuit? Is it the money required or did a lawsuit fail earlier that inhibits us to file class action lawsuit?
I agree with some senior members when they say that no one individual will come forward for the lawsuit . And I ask why should they ??
And I think, even if one single or 2-3 people do come forward it will not be possible.
This is the reason we have forums like our IV so that all can come together and take a decisive step together

If you google retrogression, IV doesn't show up until page 2.
Is there anyway we can change this? So that IV is the first link that shows up? Anyway know about this.

Be honest, I don't know the real answers. You should find a lawyer to discuss this. I just share my thoughts. For your first question. I guess you should have no problem to enter Canada as long as your Maple card is still valid. However, I think when you renew your Maple card, you will have problem. For your second question. I think you can't re-apply PR as long as you still have the PR status. I think you may have to wait until your Maple card expires. I don't know the successful rate of re-applying PR. Enough point is one consideration, your intent to stay will be another consideration. I will be surprised if the immigration officer won't question you why you gave up the last PR status. You must prepare a good answer. Let me put in this way. Consider yourself is the immigration officer, will you question the applicant who gave up the status and re-applied again? Last advice. If you want to keep the PR, you should find a good lawyer to discuss the possibility of explaining to Canadian immigration why you need more time to move to Canada.

And that was because I saw some people posting misleading information about the Sri Lankan war and I wanted everyone to see at least what I consider to be the real situation. I can't help it if people have trouble listening to different opinions and different sides of the story but this is a public forum and I have the freedom to post what I feel as long as I don't cross the line.
In any case, I am too happy today to be wasting my time on petty stuff like these.

I was on record that DOS/USCIS misallocated visas in 2005. India received much more in eb3 then what they were entitled to. In fact, India, China, Mexico and Phillipines should have not gone over their 7% as a whole of the 250,000 greencards available. Because of this; dos/uscis learned their lesson and started to follow the law appropriately.
I did say that if in 2006 any country went above their limit of 7% then it would cause a lawsuit which I would be a part of. However, there would be some negative outcomes from it. UScIS/DOS behaviour could only change going forward. They could revoke the greencards issued in 2005 for people who went over the 7% limit (uscis has upto 5 years to rescind greencard if approved by mistake) but they would not get re-allocated because there is no carryover from one year to the next in the current law. Only outcome would be to change it going forward. As I've said in the past; people were spoiled at the laziness of DOS/USCIS. Retrogression and the visa allocation should have happened a long time ago.

Because of this; dos/uscis learned their lesson and started to follow the law appropriately.
I did say that if in 2006 any country went above their limit of 7% then it would cause a lawsuit which I would be a part of. However, there would be some negative outcomes from it. UScIS/DOS behaviour could only change going forward. They could revoke the greencards issued in 2005 for people who went over the 7% limit (uscis has upto 5 years to rescind greencard if approved by mistake) but they would not get re-allocated because there is no carryover from one year to the next in the current law. Only outcome would be to change it going forward. As I've said in the past; people were spoiled at the laziness of DOS/USCIS. Retrogression and the visa allocation should have happened a long time ago.

New 3 years extension is valid till 10/2009. Visa Expired. I am from Pakistan. Where u from?
I got my Canadian PR and I have to land before 3/12/2007. My H1 B VISA STAMP expired on
8/30/2006. I got approval from another three years from USCIS but I need to go for visa stamping. I don`t want to go for US Visa stamping coz last time it took my one month for all background checks. I am avoiding for US Visa Stamping but I want to land in Canada in order to secure my Canadian PR.So any I use automatic revalidation provision of 22 CFR � 41.112(d) and come back with valid I-94 and without H1 B visa stamp from US consulate
