If you really believe that this bogus bill will become a Law, then also see the real picture, that is why I posted the other Ifs.
This Bill is titled as "Employ America Act". By having the GC, you are not an American. If you do not know the rule here it is, GC is a "Privilege", and it is not a "Right". So if this Bill passes all these people with alerady having GC will also need to pack their Bags and Go. That is the reality, dude.
So again and again do not fall over it. If you respond to this Bill, and Vote "No" against it, you are trying to send wrong messages to the originators of the bill, that we are scared. Why you guys are making everyone scared, when there is nothing to be scared about.

If I-140 has been approved, would it still be fine to apply for transfer from H1-B to F1 status by using form I-539 & university issued I-20 ? How long does it take to transfer status from H1B to F1 ? When can one start school �. Only after I-539 approval or after only applying ?
For pursuing an MBA, does it matter if one is on F1 or H4 (spouse is on separate H1)

I Agree that the economy is in a mess. But i wouldnt completly blame the Greedy CEO's and board of directors. Some part of this is with the common people . Many of these people took those fancy loans thinking that by buying a million dollar home ( even though they cant afford it) and selling it after an year for 2 million dollars created this issue. Now their debt is our ( tax payers) debt as they walked out .
With the new proposal of Fed pumping in 700 Billion dollars to recuse all these companies will cause inflation and prices will skyrocket.
As a Side note, many immigrants will be going back to their home country just bacause they cant afford these. Numbersusa will be happy as the "numbers" will be going down...
To summarize this briefly.
The rescue plan = Transfer the "crap" from the balance sheet of the banks to the balance sheet of the US gov't and taxpayers. The government is buying rotting potatos for cold hard cash.
Benefits are nearer term, Consequences are longer term.
Consequesces will be:
1) Bigger deficits, budget especially
2) Less Gov't investments in infrastructure, healthcare, education etc. As the money is needed to feed the interest repayments and other obligations.
3) Higher interest rates for everything from mortgages, credit cards auto loans student loans...... you name it.
4) Higher taxes, federal and state and city.
5) Lower US dollar and higher inflation.
Unfortunately for us the recklessness of the management of the economy of this decade will be felt as a drag on progress for a good part our working lifetimes. This was a sad and unnecessary development brought about by pure greed and an ineffective government.

Hi All, This could happen in a border state. Look, there is no need to get hyped up about this. It is my 12 year of living in a border state ( the northern border). First lived 12 miles frin the border, now about 75 miles. We have never faced this problem, neither has any one of at-least a few dozen people that I know.
Maybe the CBP had some specific information about a vehicle carrying some person(s) of interest to the US government or CBP, or some vehicle carrying contraband.
Anyways, my point is, there is simple solution to this issue. Make clear (colored, if possible)) photocopies of your and your family's passport front page, Visa page and I-94 cards and keep those in each of your vehicle's glovebox. I am sure, these along with a Driver's License will be enough to convince all but the stupidest CBP officer.
For those, who have EAD, carry it with you That simple.

I am not sure which school in India you are pointing to, but I have a 4 year degree from IIT Delhi, and I am in EB-3. Why?? No point telling you! My wife is also from IIT Delhi....on H4. Why? No point telling you!

Such an action would be illegal, but CIS has already stopped accepting I-485 applications for another category known as “Other Workers,” despite June Visa Bulletin showing that category is current. My advice to all of you is keep filing all through the month of July. For all we know, they may never issue such an illegal policy or they might lose a lawsuit filed against them. So keep filing. I understand how overflow gets distributed and Eb3-I is last in line. However , if net reduction is 35-40K each year starting 2010(i.e oct 2009 to oct 2010) and the backlog is 200 K at the beginning of 2010 (Inventory report) , we should work through all the backlog in 5 (40 *5) years.
That means in 2-3 years overflow should get to EB3 I because rest of the category will be current by then .
I agree people who applied in 2003 -2004 are looking at 10 year wait as against someone applying for EB3-I - today . Infact someone applying today will get GC in 5 years from now.

When was the last time DOS moved the dates based on calculations and pending applications ??
I know this gives a lot of 2003/2004 EB2 India folks a ray of hope. Hang on to it :)
Of course since there is nothing better to do, we can crunch the numbers and make predictions about when the dates move to what etc. :):) Nothing wrong with it. Gives us some fodder to munch on.
The folks in the line for a while know, how better these predictions have been in the past.

I am on H4 for the past 2years and this year I am trying to move to H1. The problem here is no big company responds to my resume.(Mine is not a cooked up resume. I have 6 years of experience and a lot of certifications). The only calls I get is from desi consulting firms. No US staffing firm nor BIG US firm sponsors H1s for first timers like me in US as we don't have US experience. They get their jobs done through consultants on Corp-Corp basis. Sometimes I am getting depressed seeing all this. May be I think I am forced now to go to a consulting firm to get my H1b because they are the only people who sponsor H1s in April to work in October which is 8 months from now. The system has to be revamped otherwise this system is going to exploit a lot of people like me. I cannot wait till we get a green card or work permit because it looks like it is a million years away from now. One thing I understood is that H4 dependents have no rights in this country and they talk about human rights violations elsewhere.
I agree with the points raised in the above post. If H4 dependents are given the right to work in this country things would be so much better and the wait for green card would not be so very tiresome. Not allowing H4's to work and making them completely dependent on H1B spouse is indeed a human right violation.As an H4 I have no identity in this country and the system makes me a complete dependent. (Please do not mail me back saying - If I am smart I can get an H1B, I am smart enough to work and contribute to this economy its just that my expertise may not fall under the tech/shortage skill category).
Employers are taking advantage of employees because the current immigration process supports such exploitation. This exploitation is prevalent among both with Indian and Non Indian Firms in different manner.
Also for whatever reason a number of people whose spouse is already working on H1B tends to discourage others from filing H1B for their H4spouses.I also see a similar trend where all those who has a green card wants the immigration law to be more ruthless to new GC applicants.If you look at the employment history of many among us you would find that they have come through the route of desi consulting firms fulling agreeing to the deal since they wanted the H1B at any cost.

I came in 1999 and filed GC atleast 5 times (every time sometthing went bad), spent atleast 30,000 dollars. Applied for immigration to Australia and got rejected so the anguish is natural.
If you don't mind my asking: why did u get rejected for Australian Immigration? From my understanding, it is a pretty straightforward process?
